Attorney General Orders Trump Foundation To Stop Raising Funds In New York

WASHINGTON (Reuters) – New York’s attorney general ordered Republican presidential candidate Donald Trump’s charitable foundation to immediately stop fundraising in the state, saying the Trump Foundation was breaking a law that requires charities to register with a state government agency.

“The failure immediately to discontinue solicitation and to file information and reports required under Article 7-A with the Charities Bureau shall be deemed to be a continuing fraud upon the people of the state of New York,” according to a letter dated on Friday that the attorney general’s office posted online.

The “notice of violation,” issued by the office of New York state Attorney General Eric Schneiderman, followed a series of reports in The Washington Post that suggested improprieties by the Trump Foundation, including using the foundation to settle legal disputes.

The cease-and-desist order could undercut Trump’s efforts to make the Clinton Foundation, the family charity of Democratic rival Hillary Clinton, a central line of attack in his presidential campaign against her.

Trump has sought to paint the Clinton family charity as a “pay-to-play” operation under which the former secretary of state and her husband, former President Bill Clinton, rewarded big donors to the foundation with access.

The scrutiny on the Trump Foundation came as Trump was dealing with a torrent of bad news, including his shaky debate performance against Clinton on Sept. 26 and the release by the New York Times of tax records that showed Trump taking an almost $1 billion loss in 1995 that may have allowed him to avoid paying federal income taxes for up to 18 years.

In its series of stories on the Trump Foundation, the Post reported that Trump may have violated U.S. Internal Revenue Service rules against “self-dealing” by using foundation money to purchase two portraits of himself, which were then hung at Trump’s private golf clubs in New York and Florida.

The newspaper also said that Trump may have improperly used the foundation to settle legal disputes.

In response to the Post’s reporting, Schneiderman’s office launched an investigation into the Trump Foundation.

The Trump campaign, which has previously accused Schneiderman, a Democrat, of partisan motives, said in a statement that the charity would cooperate with the investigation.

“While we remain very concerned about the political motives behind AG Schneiderman’s investigation, the Trump Foundation nevertheless intends to cooperate fully with the investigation,” said Trump campaign spokeswoman Hope Hicks.

“Because this is an ongoing legal matter, the Trump Foundation will not comment further at this time,” she added.

The New York Attorney General’s Office is the sole regulator of charities in the state. A spokesman for the office said it is not unusual for the regulator to send notices to charities whose filings are overdue or incomplete, but a cease-and-desist letter is more serious.

While letters such as the one the Trump Foundation received are not judgments of wrongdoing, they are sent only after the office gets “a clear indication of wrongdoing,” the spokesman said.

Trump established the charitable foundation in 1988, but it runs no programs of its own. Instead, it donates money to other nonprofit groups. Once it started soliciting money from other donors beyond the Trump family, it was required by New York law to register with the state.

    While it is true that Donald Trump has used his PERSONAL Foundation to bribe politicians that dropped plans to investigate him, within days of him “donating” Foundation funds; that he used charitable donations to pay personal debt; that he used charitable donations to “donate” money as if he was him doing it, the fact is that this specific revelation is not going to go anywhere. Not because it does not have merit, but because it will be perceived as a partisan attempt, by an ambitious Democratic party politician to expose a fraudulent, crooked, man running for President.
    In fact, I would be surprised if even the allegations made by a woman that claims to have been raped by Trump when she was 13 get any traction, or even exposure, by the media. Let alone any members of his rabid cult.

      Normally, I would agree. But the aggregious nature of Trump’s use of his Foundation don’t remotely fit the terms of what the IRS considers a charitable foundation. Not unless Trump considers himself the charity.

      One of the best things that has happened recently is when Gowdy tried desperately to run FBI Dir. Comey through with his Hillary Hater sword.

      Last week, at that investigation, Gowdy insinuated that the FBI was politically biased FOR Hillary.

      You know where that came from? Remember when AG Alberto Gonzalez was forced to resign from the Bush Administration for hiring ONLY Republican lawyers for US Attorneys?

      Gowdy was doing the very same thing Roy Cohn did. Deflecting his own guilt onto others. In Gowdy’s case, it was the FBI dir.

      Every single vengeful act of the Republicans since 2008 has been to “get even.” They went after Hillary as SOS because the 9/11 Commission reamed Rice’s butt.

      They went after Eric Holder to get even for AG Gonzalez having to resign. They got even with President Obama for passing the ACA because they allowed Bush to exercise what Bush publicly stated was “extraordinary executive privilege in a time of war.” Yes. Endless wars the GOP knew would continue to set all manner of precedents no Democratic president DARE EVER repeat.

        Anti government groups are not new. Posing as Republicans is. The T-potty was against government taxes and regulations. Part of them are dupes for the fascist element and that does exist. Some of them, like trump, are for themselves. Yes, all those things happened during the evil one and the child’s administration. Two good reads are: “Trumped,” and “The Making of Trump” by David Cay Johnston. Our paper, this morning, has an article by waitresses, at Trump’s golf course. Certain waitresses could not be there when trump was going to be there. If he paid a surprise visit and saw a waitress who wasn’t up to his standards, she would be fired. There are a lot of people that trump is who they are.

        I guess I did not write my post clearly enough. What Trump did with the Foundation funds was illegal. That’s the reason he was fined, at least once, when he gave the FL Attorney General a $25K bribe. Needless to say, using Foundation donations for personal use, or to pretend HE was donating money to charity was, as a minimum, misleading.

    His acts of criminality, cruelty, lying and deception, all in the name of being a “brilliant” business, as some mentally lethargic talking-heads would describe his nefarious practices, are other dimensions of a man totally unfit to be given any money whatsoever, besides enough for basic shelter, clothing, and food. And this is the man many think is worthy of consideration to lead a major influential society in the world?

    Only those with half a brain and less than an an ounce of morals would find this sort of behavior palatable and acceptable.

      Maybe you missed this part: “In response to the Post’s reporting, Schneiderman’s office launched an investigation into the Trump Foundation.”
      If it hadn’t been for that newspaper poking around, Trump could still be using other people’s money to bribe AGs to keep them from investigating him!

      That is a funny post. Apparently you have been asleep for the last 30 years. I know you are not to blame for being utterly clueless and misinformed. You have probably been swallowing Breitbart News and Daily Stormer articles and posts with breakfast each morning. I can see that it has put you in a very hateful mood and altered your thinking to the point that you no longer look for facts or honesty but merely accept what they feed you as gospel. I realize how you get comfort from your brothers and sisters in the Movement and how you feel all cozy and warm inside while they fan the flames of hate around you. However, for your mental health you are going to need to give up the security blanket which the Movement has become for you. It won’t be easy for you but if you will be brave you can do it.     First of all, whenever you hear a nasty McCarthy Era attack dog lob accusations at Hillary, all you need to do is tell them to show YOU the facts from legal documents.

    The Trump Foundation was robbed by one of Trump’s sons to afford that exclusive safari hunt of endangered species he was so proud to take his selfies of.

    What’s really happening is that Trump is showing not stupidity but bad bad BAD judgment. What would make any presidential candidate think for one second voters will not demand to know HOW he got so wealth? What would make such an imbecile mind like Trump think he could stop the leaks about his corruption in business and his lies during any election campaign? For Pete’s sake, even Mittsy took it on the jaw for his offshore tax free Cayman Island accounts. Why would Trump think he is immune?

    I’ll tell you why…he believes he can rule the universe, bend minds and generally become SUPER MAN. Sorry, not when he implies we should all be as smart as he is and pay NO taxes.

    The dirt on Trump has been known since the 90s. He had a bunch of judged in his back pocket and now most of them are either dead or hiding in some remote retreat so they don’t have to be investigated for collusion with the biggest business fraud in US History.

    He isn’t successful. He is a liar and crook. As his own father, Fred, once told him in a public exchange, “you don’t become successful by being a crook.”
