Why Not Call It Treason?

When treason became a Washington buzzword, the pushback came fast and furious.

Donald Trump Jr.’s meeting with a Russian government attorney, a Russian government lobbyist and others to obtain damaging information about Hillary Clinton does not qualify as treason, the Washington Post explained, because of the language of the Constitution.

“Treason is a little extreme for this,” said law professor Richard Briffault. “[Russia] may not be our friend, but it is not clear they are our enemy. We are not at war.”

The very allegation is a sign of the “licentiousness of the press,” sniffed the Washington Times.

Team Trump has possibly violated 52 U.S. Code Section 30121, said the experts at Slate. And even on that petty charge, scholars dispute whether a foreign government’s opposition research constitutes a “thing of value.”

Such are the pedantic ways of commentators stuck in the pre-post-modern world where (they believe) their facts are inherently superior to “alternative facts” and legalisms will (one day) prevail over right-wing rhetoric, if only liberals play nice. It’s an attractive sentiment refuted only by reality.

Common Sense

The dismissal of the treason charge, wittingly or unwittingly, abets the White House strategy of improvising a new legal defense as law enforcement closes in on the perpetrators.

The claim that the Trump campaign had no contact with the Russians and that the charge of collusion was “disgusting” has morphed into the claim that collusion with a foreign power is just “politics,” and doesn’t meet the legal definition of treason.

The goal of this strategy is to exculpate Team Trump from criminal charges as new facts emerge. There’s no reason why Trump’s critics need to play along.

The commonsense definition of treason is “betrayal of country,” the standard that Team Trump has interpreted broadly for its own purposes.

In 2016, New Hampshire State Rep. Al Baldasaro said Hillary Clinton “should be shot for treason.” Last month Baldasaro was invited to the White House.

Team Trump has no grounds for criticizing anyone for a loose definition of treason. For the White House, “treason” is a useful stick to bludgeon its opposition.

‘Effecting By Force’

Trump’s critics have a higher standard: treason is a plausible, if not yet proven, interpretation of the acknowledged facts.

Contrary to Professor Briffault, treason as defined in the U.S. Constitution and the law does not require that the enemy be “at war” with the United States. Article 3 of the U.S. Constitution states, “treason against the United States shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort.”

The legal meaning of “levying war” is not synonymous with “at war,” nor does it require a formal declaration of war.

The definition of levying war is:

“the assembling of a body of men for the purpose of effecting by force a treasonable object, and all who perform any part however minute, or however remote from the scene of action, and who are leagued in the general conspiracy, are considered as engaged in levying war, within the meaning of the Constitution.”

The question is: Did Donald Trump Jr., Jared Kushner and Paul Manafort assemble with assorted Russian government representatives on June 9, 2016, for the “purpose of effecting by force a treasonable object?”

The question cannot be answered because we have not yet heard Kushner and Manafort’s account of the meeting. We don’t know what they hoped to effect. Special Prosecutor Robert Mueller is making inquiries.

What we do know is that the Trump White House’s account of the meeting is fraudulent (no, it wasn’t about adoption as the Trumps originally claimed) and that fraud can be a form of force.

In other words, the assertion of treason may be premature, but the accusation is not. The possibility of treason cannot be excluded based on the available evidence, as Senator Tim Kaine noted.

“Nothing is proven yet,” Kaine told CNN. “But we’re now beyond obstruction of justice in terms of what’s being investigated. This is moving into perjury, false statements and even into potentially treason.”

The available evidence shows that the actions of Team Trump are potentially treasonous. The buzzword, properly modified, is precise, if not prescient.

    Nobody is calling Trump’s actions, and that of his closest advisors, treason because the Federal government, and most governorships and State legislatures, are controlled by people more interested in their personal interests than enforcing the law consistent with the tenets outlined in the Constitution. If meeting with foreigners with close ties to a government that has been hostile to the USA for decades does not constitute treason, what does? If encouraging a country that has been an adversary of the USA for decades to spy on us and share their findings with the general public does not constitute treason, what does? If proposing the establishment of a communication medium that utilizes the systems of a foreign government to keep information away from the American people does not constitute treason, what does? The definition of treason, collusion, and unethical behavior has become meaningless because those in power are more interested in retaining their influential jobs than because there are no basis to call a spade a spade. Unfortunately, the worst part of all this may involve Generalissimo Trump firing the Special Counsel that is investigating Russian involvement in the 2016 election, and collusion by the Trump administration. Should this happen, the line between dictatorial behavior and lawlessness, and Trump’s behavior, will be so fine it will be almost invisible…and with the exception of a few feigned expressions of indignation, he will get away with it by wrapping himself in the flag and engaging in discourse that is itself a rejection of everything the Constitution stands for.

      They aren’t calling it treason because they would rather he go to jail for his crimes. And make no mistake, Trump is desperate to stop investigations into his financial deals because the skank that he is has made Art of the Deal into Art of Masterful Money Laundering.

      In order for lawyers to prove treason, they have to prove malice of intent. With Trump being so impulsive, that would be harder to prove than money laundering they can see in black and white.

    Trump has dumped himself into his own trick bag, and in desperation he and his team of servile lackeys are in a tizzy trying their best to hide. Running has been effective up to now, but Jared and Trump Jr. both have aided in getting a noose around Trump’s neck. A little more time and the trap door will be opened, and Trump will be swinging in the breeze, not by a lynch mob, but by virtue of his own willful and irresponsible decisions.

    As stated before here, Trump has operated for decades under the fatal assumption that his arms are long enough to box with God—a metaphor. Being utterly dismissive of the absolute necessity to develop one’s spiritual qualities, to at least give the semblance of trying to be moral, and to show some contrition and humility, Donald has opted to go the way of that which is termed Satan—the one as described in the Bible as Iblis, or in the Qur’an as Shaytaan. “Satan” was cast out of heaven, which is a metaphor explaining that the single-most reviled attribute—the ego— is incompatible in the Most High Realm, as more aptly described by Baha’u’llah, and therefore anyone carrying such baggage has no place in the same realm as those who exerted efforts to develop spiritual qualities, and places himself “away” from God, as opposed to being “near” God. The former has been clarified by Baha’u’llah to refer to “Hell”, and the latter as “Heaven”.

    “O SON OF EARTH! Wouldst thou have Me, seek none other than Me; and wouldst thou gaze upon My beauty, close thine eyes to the world and all that is therein; for My will and the will of another than Me, even as fire and water, cannot dwell together in one heart.”

    Trump, and all those who are aligned with or are in support of his actions, are in the same trick bag as Donald, and have this morbid fascination with being opposed to the Will of God. And this translates into various demonic behavioral patterns like sexual assault, racism, hatred of one’s fellow human beings, murder, healthcare denial, exorbitant charges for basic necessities and medical services, greed, etc.—and not listed in any particular order of degrees of transgression.

    It strikes me that Trump and so many of our politicians at all levels—as is Putin and others in the world— are treading on very thin ice at this stage in their earthly lives.

      I think it’s is kind of amusing that Trump is so desperate to find out what it is the Special Prosecutor has on him. And make no mistake. Mueller is going down a path that is bound to uncover the most massive Russian intereference in our government and our country that no one thought possible.

      Prediction: When Mueller ties together all of Trump’s Russian oligarch business deals, the pattern of money laundering will make Madoff’s theft of $67 billion look like peanuts.

      Trump was instrumental in selling a lot of US real estate to Russians. Now, he’s trying to make it appear that was “just business as usual.” Not when the money they bought that real estate with was laundered through a Forex bank and European banks.

      Deutschebank already got caught once laundering Russian money and got a $320 million fine in 2013. Now, they are under investigation again.

      The right wing will make it look as if money laundering is no big deal. Oh no? Not when that money is laundered in the US and ends up in Putin’s government bank.

      I’ve said from the get go Trump is dirty. Since his campaign, he now has nearly 4,000 lawsuits for various attacks and mouthing off with his lies.

      It has always been about what Trump is hiding. He goes to such extremes to stop an investigation into his collusion with Russia that he is now threatening a special prosecutor.

      Trump hasn’t a leg to stand on even with his corrupt team of lawyers, none of whom are Constitutional lawyers..just a bunch of Mafia defense lawyers Trump put together because he is as much a thug as his lawyers former defendents, Gotti and Giganti.

          Because Trump suffers from Narcisstic Personality Disorder of the most extreme degree, any man who earns success honestly, like Obama, is a natural enemy.

          You have to wonder what kind of cesspool he was raised in. For the 4 decades he has been in our NY/NJ Metro region media, we all knew he was “off.” But, mostly he spent his time trying to extricate himself from the fact that Mommy Mary Ann was a Scottish immigrant who worked as a house maid and Daddy Fred wasn’t born rich either. Trump’s grandfather died when his father was a boy of 12.

          It was Trump’s grandmother, Elizabeth Christ Trump, who with her son, Fred, began a career in home sales. Not exactly in the big time either. They basically built and managed homes, apartments and barracks for the U.S. Navy along the East Coast.

          He only comes to NJ to fulfill the occupancy law at that Bedminster golf course. In NJ, any property with a business on it can be business tax exempt IF the owner proves occupancy a specific number of days a year. That’s why Trump has to be there in Bedminster. To avoid paying business taxes. To play on that course costs $200,000 a pop and is only open to the elite.

            Trump is such a massive embarassment to educated Americans. We hear what he says and then cringe. What is scarier is that he is leaving military decisions to Mattis who is having to resort to consulting with the Obama Administration Pentagon people on serious issues like Syria.

            It’s obvious Putin is after control of Syria and is hiding the fact he’s getting help from Iran. The very Iran that the Republicans fought like hell to stop the removal of sanctions.

        As for Trump’s lame ass excuses that Mueller is guilty of conflict of interest so he can fire Mueller, Trump’s lawyer picked that line from the Justice Department laws that state and I quote, “removal of special counsel can ONLY be done “only by the personal action of the AG and ONLY for misconduct, dereliction of duty, incapacity, conflict of interest or other good cause.”

        What would Trump fire Mueller for if not for refusing to kiss Trump ASS and be loyal to the president and not his country?

          The investigation, with today’s interview completed, is history. Mueller is still looking for his 15 minutes of fame, but he now knows that he can’t really make any charges for two reasons: 1) there was nothing illegal done and thus no crimes committed, and 2) he’s made the classic mistake of bringing biased assistants on board. This is a tip off that they are going to produce not one charge. Otherwise, the case would be considered biased and carry no weight.

          I guess you’re just going to continue to foam at the mouth, but I’m trying to get you to accept reality.

            President Trump DIDN’T kiss NYT to make threats about firing anyone, least of all Mueller. Muller will be dismissed because he is using resources that contributed to HilLIARy’s campaign and thus they lack credibility.

            You keep thinking you will someone dig up dirt on President Trump, but it hasn’t happened in 9 months and will not happen. Lawsuits are meaningless!

    Money laundering is not something Trump considers illegal. He’s already paid a hefty $25 million fine for his first offense. The government and law enforcement know that it wasn’t the first and only time.

    Trump might also be guilty of obstruction of justice beause his plan is to fire Sessions who had to recuse himself due to his connections to the Trump campaign. So Trump gets rid of Sessions, replaces him with someone who can’t be recused and then Trump gets that AG to fire Mueller for some “Trumped” up reason.

    If Trump pulls off that stunt, he creates a Constitutional Crisis that doesn’t end the investigation he’s so desperate to stop. It would then be the domain of the House of Representative to file a charge of obstruction of justice.

    Trump believes he can rule like a czar but he forgets he is only ONE branch of the US government. Not ALL branches.

    He wants the FBI Dir. to report directly to him as well as all other law enforcement departments. Unless you are totally brain dead, you can see where he is going with his CEO style power plays.

    He allows himself to be interviewed by the NYT and then has Sarah Sanders Fat Ass tell the country he has “no” intentions of firing Mueller. Trump knew he was using the NYT to make sure AP and the world picked up his interview with the NYT he calls “fake news.” But when he wants to make his threats well known to those he is attacking, he knows not to use “fake news” no sane person bothers to read.

    He’ll fire Mueller, Sessions and Rosenstein. But, he’ll do what he always does..let the threats sink in and the country be lulled into a false sense of security because Fat Ass Sarah said he isn’t planning to fire Mueller. BS. He’ll will fire him just not until no one expects it.

    If ever there was proof the Republican Big Boys cannot possibly stay one step ahead of Trump, they are proving it like champs.

    It’s all “fake” news until he needs to make threats. What the hell makes him think he and he alone can threaten the entire government? Time for him to wave the white flag of surrender.

      What is going to bring him down, if he allows the ongoing investigations to proceed and the Republicans have the guts to challenge his dictatorial traits, is money laundering. The warning he sent to Special Counsel Mueller was not an idle threat. Don’t forget Donald Jr’s acknowledgement in 2008 when he said that much of their wealth came from Russia. Considering the fact that Trump bags about being a billionaire, is it reasonable to think that most of his wealth comes from a few hotels and golf courses in Russia? Hardly. The Russian connection involves the enormous wealth accumulated by Putin ($200B) and by the oligarchs around him. Much of that money has been either deposited in Western banks or laundered to willing Westerners who benefited from those transactions…and are beholden to Putin and the rest of the Russian mafia. Trump does not praise and openly admire Putin because of his cold demeanor and deeds. He loves the guy because he has benefited financially from Putin’s transfer of wealth to the West. That’s where the Matinsky Act comes into play. Not because Putin retaliated by banning Westerners from adopting Russian orphans, but because it allows Western governments to freeze the assets of those guilty of human rights abuses and fraud. Putin, and his emissaries, could care less about the adoption issue. They want Trump to unilaterally get rid of the legislation that threatens his wealth and Tsarists dreams.

          Here in the NY/NJ Metro area, we suspected there was some bizarre little money laundering game between Trump, his Saudi High Rollers and the Russian oligarchs he was selling US properties to.

          The reason for these suspicious was that Trump declared bankruptcy in 2013 nearly as soon as he got that FinCEN fine for money laundering at his NJ casino. All of this is documented at the U.S. Treasury and FinCEN.gov sites.

          However, Trump also claimed in 6 corporate bankrutcies he didn’t have the money to pay his hotel and casino employees or the contractors he owed money to. He claimed he had a total of only $995 million left. $2 million a month goes to his first and second wives for their alimony and he had already made a deal with Russia (let’s pretend he never met Putin to discuss the building of that Moscow Trump Hotel, right?) to build a hotel in Moscow and Azerbaijan. Neither of which he could possibly have had the money to do without the help of Deutschebank lending him billions.

          But then, Deutschebank, a Forex bank, got a $320 million fine for laundering Russian money.

          It shouldn’t be difficult to see what the Russians under Putin were doing…infiltrating the US by buying up property with laundered money through the only bank that would lend Trump any money due to his reputation for not paying what he owes: Deutschebank.

          Now, Deutschebank handed over Trump’s banking records to Mueller via subpoenae.

          However, the real problem comes when the Special Counsel has to acquire the records of foreign banks (namely Putin’s government bank in Russia) who lent Trump money.

            If he admitted to it, (completely unheard of from Trump) that means the 10 million dollar fine was pretty minor compared to the money the Russian and Saudis were funneling to him.

            The RICO and racketeering charges in NY State are still pending and might go global. Trump made millions on that bogus Trump University. Though he settled out of court…like FinCEN, he was able to write off the fine and paid no taxes on the over millions he earned from fraudulently misrepresenting Trump University.

            If Robert Mueller is ever able to get to the bottom of Trump’s numerous business deals, it will likely show more money laundering.

            The righties love to make it look like that’s “just business as usual.” Yet, it is Trump himself fighting like hell to stop an investigation into his business practices.

            There isn’t enough money in the Russian government bank for Trump to settle out of court this time.

            One good thing though is that the business practices that have cause so much corruption are now in the faces of all Americans and we have Trump to thank for that. rofl.

        I agree. The real problem for Trump is that he is desperate to make all of his business deals “proprietary” whether they are legal and above board or not.

        He already has one charge of money laundering against him. He has a NY state lawsuit for RICO violations and rackeeteering waiting for him the minute he loses that title he thinks he has. NY’s AG Eric Schneiderman is only waiting on the Special Counsel Mueller to complete the investigation of Trump Organization which is the total focus of the investigation as it would be when money and real estate deals with Russian oligarchs change hands in the US.

        I laugh and laugh when the media continues to imply that Trump has never met Putin until the G20. I would love to know if there are any Russian PR photos of Putsy sitting as close as possible to the runway when Trump brought the Miss Universe pageant to Moscow.

The reality is that the Magnitsky Act (H.R. 6156) was passed by the 112th Congress as a bi-partisan House and Senate legislation. It was introduced by Republican Michigan’s House Rep. Dave Camp on July 19, 2012 through the House Ways and Means sponsorship. It was name for Sergei Magnitsky, a Russian lawyer, whose arrest and subsequent death in custody generated international media attention and triggered both official and unofficial inquiries into allegations of fraud, theft and human rights violations.

        The Magnitsky Act places severe sanctions on Russia mainly for human rights violations. At that time, the number of deaths of dissidents and anti Putin journalists was growing. Some, like Boris Nemtsov were poisoned 3 times using a chemical only the Russia government has access to. He was fatally shot in February 2015.

        How any sane person can EVER consider making deals with a murderous assassin like Putin is beyond the ken.

    If you heard Trump at the Boyscout Rally yesterday, you saw the beginnings of what Trump is planning: A whole generation of Trump Youth. Not so different from the way Hitler created his Hitler Youth. Start by reminding them of their futures under the Almighty god hero Trump and then reinforce his need to blow up his ego by turning a boyscout rally into a Rah Rah Rah Rah Rah Trump session.

    I watched for less than 5 seconds before those phony ass hand signals started. By then he was up to “Give ’em hell!” This for young boys he knows will turn on their parents if Trump decides to go that far.

    Trump is now cutting the House and Senate out of his deep state White House government. His plan is to use their recessess as his vantage point to fire anyone he wants, especially Sessions and Mueller. There is only one reason to do that: So Trump doesn’t get his Lard Ass caught in the corruption cesspool HE and no one else created.

    This nut has been trying to stop this investigation almost like a heroin addict gets desperate for their next fix.

    The one thing Trump cannot do is fire Mueller without cause. And if he fires Sessions first, that seals Trump’s fate. Sessions is a good ole boy who was a Senator with lots of “friends in the Senate” who won’t fail to take Trump down for dishonoring one of their own. It wouldn’t surprise me if they already have a rebel plan of action in the works.

    The trick with Trump is to nab him at his most vulnerable. That would be one of his family members. He went soft on Kushner but you can bet if Iskanka or Donny Jr. end up in the soup for their criminal actions and violations as members of Trump’s campaign and their contacts with Russia which is an open violation of CFR laws regarding election procedures, break the necks of these two and Trump breaks in half.

    It may not be called “treason,” but it certainly comes very close to collusion, especially if the main reason why Trump Jr went to the meeting was because he thought he was going to get some “dirt” on Hillary! If that’s his ONLY reason for attending the meeting, which it appears it was, then it was clearly inappropriate and he should have reported the call to the FBI before attending the meeting.
